Terms & Conditions

Payment

Honeycomb can accept payment as follows:

  • Cheque
  • Direct Bank Deposit
  • Credit Card (Visa, MasterCard, Diners Club, AMEX via via our secure e-Commerce site)

Terms of payment are 100% upfront, payable at time of order placement.

Clients

The end user ? the adviser or accountant practice ? receiving the goods is the client and is the party that is responsible for payment of The Hive?s services, except when alternative arrangements are made.

Quality guarantee

The Hive offers a quality guarantee ? if the client is not happy with the finished goods provided due to fault or error, Honeycomb will replace the goods at our cost.

Delivery

The goods will be delivered within 30 days of order. The Hive reserves the right to extend or amend the delivery guarantee if the client or their nominated compliance officer does not adhere to the approvals schedule or process.

Marketing Services Fees

Marketing services fees are built into the product costs and cover management, professional and administration time and costs, and basic secretarial services consistent with the operation of a clients? account. The consultancy is entitled to a supplement to the agreed project fee for substantial extra work required by the client not anticipated in the original planned program, so long as prior approval is gained from the client.

Disbursements

Disbursements are in addition to consultancy fees and include such items as the following:

  • Travel, accommodation, meals and entertaining (as agreed with the client)
  • Postage
  • Courier services

Goods and Services Tax

GST will be charged on all fees and expenses incurred and billed, in accordance with a New Tax System (Goods and Services Tax) Act 1999. This tax will be added to the total of the invoice.

Billing and Payment Terms

  • All orders placed require a 100% upfront fee.

Approval, Authority and Indemnity

  • The consultancy will submit all copy, design, and artwork to the client and nominated compliance officer for approval. The approval will be in the form of a signed authorisation or as otherwise agreed with the client.
  • Approval by the client will be sufficient authority to publish.
  • In the event of cancellation or amendment, the client will reimburse or indemnify the consultancy for any charges incurred.
  • In the settlement of any dispute with a supplier properly engaged (either as principal or as agent for the client) to provide goods or services, the consultancy has the right to act for itself and, on behalf of the client, to negotiate a settlement. In such cases, the client must indemnify the consultancy for the amount of the settlement.
  • The client shall be responsible for the accuracy, completeness and propriety of information concerning its organisation, products, industry and services that it furnishes to the consultancy. It will be the client?s responsibility to review all promotional or advertising materials prepared by the consultancy under this agreement and to confirm that any representations made with respect to its products or services are supportable. The client shall also be responsible for confirming the accuracy and legality of the descriptions and depictions of its own products and services and/or the products or services of any competitors.

Copyright

The copyright of all artwork, copy, proposals, and other work created by the consultancy vests initially in the consultancy. On payment by the client of the relevant fees and charges in full, the client becomes entitled to the said copyright and the assignment of it in each case becomes effective on payment.

Confidentiality

The consultancy acknowledges its duty not to disclose any confidential information relating particularly to the client?s business, during or after the term of appointment, without permission from the client.

Termination

The upfront fee payable is considered a deposit and will not be refunded in the instance of order cancellation where the client is at fault. Where Honeycomb is at fault, the order will be fulfilled.
